Asics Launches Suit Against Steven Madden

NEW YORK — Asics America Corp. has launched a lawsuit against Steven Madden Ltd. alleging the company infringed on Asics’ trademark stripe design.

According to documents filed in a California district court on Tuesday, Asics alleged that Steve Madden’s Stryker, Swift, Sweeper and Kwick designs use a stripe design that is “confusingly similar” to the Asics stripe design mark, which Asics has exclusively used for about 40 years.

In addition to trademark infringement claims, Asics also is seeking damages for breach of contract from an earlier settlement with Steven Madden, under which terms are confidential, along with claims of unfair competition and trademark dilution.

Representatives from Steven Madden weren’t immediately available to comment on the suit.
